PrintKit ("PrintKit," "the app," "we," "us," "our") is a Shopify app operated by Big Chato's Apparel LLC, Madison, Virginia, USA ("Big Chato's Apparel"). These Terms of Service ("Terms") govern a merchant's ("you," "your") installation and use of PrintKit. By installing or using PrintKit, you agree to these Terms. If you do not agree, do not install or use the app.

These Terms incorporate by reference the PrintKit Privacy Policy and, for the processing of personal data, PrintKit's Data Processing Addendum (available on request from support@printkit.tech).


1. The service

PrintKit adds custom-product design builders to your Shopify storefront and helps you turn a shopper's design into a production-ready print file and a work ticket you use to fulfill the order. PrintKit reads and writes a limited set of Shopify data (products, draft orders, and orders) under the Shopify permissions you grant at install, as described in the Privacy Policy.

2. Eligibility and accounts

You must have a Shopify store and the authority to bind that store to these Terms. You are responsible for maintaining the security of your Shopify account and any credentials used to administer your store. You must keep your Shopify Partner/admin account protected with a strong password and two-factor authentication where available.

4. Your data and your shoppers' data

As between you and Big Chato's Apparel, you (and your shoppers) own your store data and the designs created in your builders. PrintKit acts as a data processor on your behalf for the shopper personal data it handles (the customer name on the work ticket, plus order and design data). Our handling, retention, encryption, and deletion practices are described in the Privacy Policy. You are the data controller for that data and remain responsible for your own privacy disclosures to your shoppers.

5. Fees and billing

If your plan is a paid plan, fees are billed through Shopify's billing system according to the plan you select in the app. Taxes, if any, are handled through Shopify. Plan features and limits are described in the app. We may change pricing prospectively with reasonable notice; changes do not apply to a billing period already paid.

6. Availability, backups, and no warranty

We aim to keep PrintKit available and we run automated, encrypted daily backups of app data with a tested restore procedure. However, PrintKit is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free. You are responsible for retaining your own records of orders in Shopify (the system of record for your orders and customers).

7. Limitation of liability

To the maximum extent permitted by law, Big Chato's Apparel will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of PrintKit. Our total aggregate liability for any claim arising out of or relating to PrintKit will not exceed the greater of (a) the amount you paid us for PrintKit in the three (3) months before the claim arose, or (b) USD $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

8. Indemnification

You agree to indemnify and hold harmless Big Chato's Apparel from claims arising out of the content your store or your shoppers submit through PrintKit, your violation of these Terms, or your violation of any law or third-party right.

9. Suspension and termination

You may stop using PrintKit at any time by uninstalling it from your Shopify admin. We may suspend or terminate access for a material breach of these Terms or where required to protect the service or comply with law. On uninstall, your PrintKit data is deleted following the process described in the Privacy Policy (including Shopify's shop/redact webhook), and the shop's encryption key is destroyed (crypto-shredding).

10. Changes to these Terms

We may update these Terms. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify merchants through the app or by email. Continued use of PrintKit after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules, except where mandatory consumer or data-protection law provides otherwise. Nothing in these Terms limits any non-waivable statutory rights you may have.
